Who is responsible for processing your personal data?

CLJ Kaisushi SL is responsible for processing the User’s personal data and informs that such data will be processed in accordance with the provisions of Regulation (EU) 2016/679 of 27 April (hereinafter, “GDPR”), and Organic Law 3/2018 of 5 December (hereinafter, “LOPD”).

Any person who accesses this “Website” assumes the role of “User,” committing to the strict observance and compliance with the provisions set forth herein, as well as any other applicable legal provisions.

What data do we process about the User?

The Website collects the name, surname, email address, and phone number of Users when making a reservation or communicating via contact forms.

Kaisushi expressly reserves the right to unilaterally modify, in whole or in part, the amount or content of the data that may be required, without this giving rise to any obligation of notification or communication with respect to the Users of the Website, with the update on the Website of Kaisushi being considered sufficient.

Without prejudice to making updates to this Privacy Policy available to the User, the User acknowledges and agrees that it is their responsibility to review this Privacy Policy each time they interact with the Website.

For what purpose do we process your personal data and why?

Depending on the form through which we have obtained your personal data, we will process it confidentially for the following purposes:

  • In job application forms: to include the applicant in recruitment processes and to analyze the applicant’s profile in order to select a candidate for the vacancy held by the controller. (based on the data subject's consent, 6.1.a GDPR).
  • In reservation forms: to formalize bookings at the establishment of Kaisushi. (for the performance of a contract or pre-contract, 6.1.b GDPR) and to send commercial advertising communications by email, fax, SMS, MMS, social networks or any other present or future electronic or physical means to clients, enabling commercial communications regarding products or services similar to those initially contracted by the client (Art. 21.2 LSSI). (based on the legitimate interest of Kaisushi, Art. 6.1.f GDPR).
  • In contact forms: to respond to inquiries or any type of request made by the User through any of the contact methods available on the Kaisushi website. (based on the legitimate interest of Kaisushi, Art. 6.1.f GDPR) and to send commercial advertising communications by email, fax, SMS, MMS, social networks or any other present or future electronic or physical means, enabling commercial communications. These communications will be carried out by Kaisushi and will relate to its products and services, or those of its partners or suppliers, with whom it has reached a promotional agreement. In this case, third parties will never have access to the personal data. (based on the data subject's consent, 6.1.a GDPR). To carry out statistical analyses and market studies. How long will we retain your personal data?

They will be retained no longer than necessary for the purpose of the processing or for as long as there are legal obligations for their retention, and once they are no longer necessary, they will be deleted using appropriate security measures to ensure the anonymization or total destruction of the data.

With respect to data processed for employment candidacy purposes, the data will be kept for a maximum period of one year, after which they will be deleted, ensuring full respect for confidentiality during both processing and destruction. After this period, if you wish to continue participating in selection processes for Kaisushi, please send us your CV again. Should any change occur in your data, please notify us as soon as possible in writing, to ensure your data is properly updated.

To whom do we disclose your personal data?

To fulfill the purposes outlined above, Kaisushi may need to disclose, transfer, or otherwise share your personal data with other entities within the Kaisushi group or with third parties.

In general, we may disclose, transfer, or share personal data in the following ways:

  • With service providers: Kaisushi may disclose personal data to third-party service providers where necessary for service provision. These services include data storage and analysis, web hosting, IT technology, infrastructure and security, payment transfer management, advisory services, maintenance, and similar services. When Kaisushi outsources processing activities, it ensures that the service provider is required to implement and maintain appropriate security and data protection measures and complies with applicable privacy laws.
  • With advertising and marketing partners: Kaisushi works with third-party companies to display more relevant online advertising. These companies may collect cookie IDs, IP addresses, and other identifiers, as well as information about the pages you visit on our sites and other websites, to enable them to display advertising for products and services that may interest you when you visit our website or other websites.
  • When required by law or to protect our rights: in certain cases and where permitted by applicable law, Kaisushi may be required to disclose your personal data to comply with legal obligations, such as with tax authorities or binding requests from other law enforcement authorities, or to protect the legal rights of Kaisushi, such as defending a legal claim where permitted by applicable law.
  • As part of a corporate transaction: additionally, if a business unit of Kaisushi is sold or transferred as part of a corporate transaction, it may be necessary to disclose your personal data to a purchasing entity, including in relation to due diligence carried out prior to such an event where permitted by applicable law.

We may share aggregated or anonymized information with third parties for research, marketing, analytics, and other purposes, provided that such information does not identify any individual person.

What are your rights?

The User has the right to access their information, as well as to rectify it, transmit it, and delete it, and to limit or object to certain uses of their information. Kaisushi is committed to respecting the confidentiality of the User’s personal data and to ensuring the exercise of their rights.

Likewise, we inform you that at any time you may exercise the rights listed below by sending an email to xianda@kaisushiexperience.com, indicating the reason for the request and the right you wish to exercise.

In particular, regardless of the purpose or legal basis for which we process the data, the User has the right to:

  • Be informed clearly, transparently, intelligibly and accessibly, in plain and simple language, about the use and processing of their personal data.
  • Request access to the data that Kaisushi holds about them.
  • Request that the data held be rectified. By actively providing their personal data through any means, the User guarantees that the data is accurate and true and undertakes to notify any change or modification thereof.
  • Request the deletion of their data when it is no longer necessary for the purposes for which it was collected, or where there is no longer legal justification for its processing.
  • Request the restriction of the processing of their data, meaning that in certain cases the User may request a temporary suspension of data processing or retention beyond the necessary time when they may need it.
  • Object to the processing of their personal data, including profiling.
  • Furthermore, if the User has given consent for the processing of their data for any purpose, they also have the right to withdraw it at any time. To do so, they may send a written request to the postal address or email address of the organization indicated above. The request must include, at a minimum, the following information:
    1. A photocopy of your ID card or equivalent document to verify the User's identity.
    2. The purpose of the request, i.e., the right being exercised.
  • If the User considers that their rights regarding the protection of personal data have been violated, especially when they have not obtained satisfaction in exercising their rights, they may file a complaint with the competent Data Protection Authority through its website: www.agpd.es.

Mandatory or optional nature of the information provided by the user

By checking the corresponding boxes and entering data in the fields marked with an asterisk (*) on the contact form or in download forms, Users expressly, freely, and unequivocally accept that their data is necessary for the provider to handle their request, with the inclusion of data in the remaining fields being voluntary. The USER guarantees that the personal data provided to Kaisushi is truthful and is responsible for communicating any changes to it.

Kaisushi informs that all data requested through the Website is mandatory, as it is necessary to provide an optimal service to the User. If not all data is provided, it cannot be guaranteed that the information and services provided will fully meet the User’s needs.

Security measures

In accordance with current regulations on personal data protection, Kaisushi complies with all provisions of the GDPR and LOPD regarding the processing of personal data under its responsibility, and in particular the principles described in Article 5 of the GDPR, under which data is processed lawfully, fairly, and transparently in relation to the data subject and is adequate, relevant, and limited to what is necessary in relation to the purposes for which it is processed.

Kaisushi guarantees that it has implemented appropriate technical and organizational policies to apply the security measures established by the GDPR and the LOPD in order to protect the rights and freedoms of Users and has communicated the appropriate information for them to be able to exercise those rights.

Processing of personal data

Kaisushi is responsible for processing the User’s personal data and informs that such data will be processed in accordance with the GDPR. The following information about processing is provided:

  • Processing purposes: as specified in the section on cookies used on this Website.
  • Legal basis for processing: except where necessary for website navigation, based on the data subject’s consent (Art. 6.1 GDPR).
  • Data retention criteria: as specified in the section on cookies used on the website.
  • Data communication: data will not be communicated to third parties, except for cookies owned by third parties or where there is a legal obligation.
