CLJ Kaisushi SL, in its capacity as the party responsible for the website (the “Website”), makes this document (the “Legal Notice”) available to users, in order to comply with the obligations set forth in Law 34/2002 of July 11, on Information Society Services and Electronic Commerce (hereinafter, “LSSI”), as well as to inform all users of the Website about the conditions of use.
Any person who accesses this Website assumes the role of “User,” committing to the observance and strict compliance with the provisions set forth herein, as well as any other applicable legal provisions.

2. Conditions of Access and Use of the Website

Kaisushi guarantees free access to and use of the Website. Some services may require prior contracting.
The User guarantees the authenticity and accuracy of all data provided to Kaisushi and shall be solely responsible for any false or inaccurate statements made.
Additionally, the User must use the Website in accordance with the applicable legal conditions and the terms of use established by Kaisushi.
In this regard, and by way of example, not limitation, the User shall refrain from:
I. Using the Website's communication channels (e.g., reservation forms, customer support chat, or contact forms) unlawfully and/or to disseminate criminal, violent, pornographic, racist, xenophobic, offensive, terrorist, or in general, content contrary to the law or public order.
II. Introducing any kind of computer virus or process that may alter, damage, interrupt, or cause errors in the electronic documents, data, or electronic and logical systems of Kaisushi or third parties; and hindering access by other Users to the Website and its services.
III. Using the Website to appropriate the intellectual property rights of Kaisushi, including, broadly speaking, publicity rights, copyrights, or any other rights recognized by law.
IV. Impersonating another User in contact forms.

3. Data Updates

Kaisushi expressly reserves the right to unilaterally modify this Legal Notice, in whole or in part, without any obligation to notify or communicate such changes to the Users of the Website, with publication on Kaisushi's Website being deemed sufficient.
Without prejudice to making the updates to this Legal Notice available to the User, the User acknowledges and accepts that it is their responsibility to review this Legal Notice with each interaction with the Website.

4. Intellectual and Industrial Property Rights

The Website, including but not limited to its programming, editing, compilation, and other elements necessary for its operation, designs, logos, text, and/or graphics, are the property of Kaisushi, or, as the case may be, it holds a license or express authorization from the authors.
All Website content is duly protected by intellectual and industrial property laws and registered in the corresponding public registries. Regardless of the intended purpose, total or partial reproduction, use, exploitation, distribution, and commercialization require prior written authorization from Kaisushi. Kaisushi does not grant any license or authorization of any kind over its intellectual and industrial property rights or any other property or right related to the Website, and under no circumstances shall access and browsing by Users be understood as a waiver, transfer, license, or total or partial assignment of such rights by Kaisushi.
Any unauthorized use by Kaisushi is considered a serious infringement of the author's intellectual or industrial property rights. The designs, logos, text, and/or graphics not owned by Kaisushi that may appear on the Website belong to Kaisushi. Kaisushi reserves the right to take any legal or extrajudicial actions deemed appropriate against the User.
Kaisushi expressly authorizes third parties to redirect directly to specific content of the Website, and in any case, to the main Website at www.kaisushiexperience.com. Kaisushi recognizes the corresponding intellectual and industrial property rights of their respective holders; their mere mention or appearance on the Website does not imply the existence of any rights or responsibility over them, nor any endorsement, sponsorship, or recommendation by Kaisushi.

It is expressly stated that the User is obliged to report to Kaisushi any incident, action, or omission they may detect regarding the infringement of copyright or any intellectual or industrial property rights of Kaisushi, including attempted or actual breaches of personal data protection policy, illegal transfers of data, or widespread data theft of Users, including phishing or hacking attempts.

5. Disclaimer of Liability

Kaisushi assumes no responsibility (contractual, non-contractual, or of any other kind) for the information published on the Website, provided that it does not have effective knowledge that such information was posted, manipulated, or introduced by a third party unrelated to Kaisushi, or if it did, it acted diligently to remove the data or block access to it.
The User uses the Website at their sole and exclusive risk and subject to the following disclaimers.

Link Policy

Through the Website, Kaisushi may redirect Users to content from third-party websites.
As Kaisushi cannot always control the content introduced by third parties on their respective websites, it assumes no responsibility for such content. In any case, it will proceed to the immediate removal of any content that may contravene national or international legislation, morals, or public order, and will immediately remove the redirection to the said website, informing the competent authorities of the content in question.
Kaisushi is not responsible for the information and content stored, including but not limited to forums, chats, blog generators, comments, social networks, or any other medium that allows third parties to publish content independently on the Kaisushi Website. However, in compliance with Articles 11 and 16 of the LSSI, it makes itself available to all Users, authorities, and law enforcement, actively cooperating in the removal or, if necessary, blocking of all content that may affect or contravene national or international laws, third-party rights, or morals and public order.
If the User believes that any content on the Website may be classified in this way, they are kindly asked to notify the Website administrator immediately. This Website has been reviewed and tested to function correctly. In principle, correct operation 24 hours a day, 365 days a year can be guaranteed. However, Kaisushi does not rule out the possibility of certain programming errors or causes of force majeure, natural disasters, strikes, or similar circumstances that may make access to the Website impossible. Under no circumstances will Kaisushi assume any responsibility for blocking or inaccessibility caused by such events.

IP Addresses

The Website servers may automatically detect the IP address and domain name used by the User. An IP address is a number automatically assigned to a computer when it connects to the Internet. All this information is recorded in a duly registered server activity log that allows for subsequent data processing to obtain purely statistical measurements that help determine the number of page impressions, number of visits to the web servers, order of visits, access points, etc.

7. Applicable Law and Jurisdiction

For the resolution of all disputes or issues related to this Legal Notice and/or the Website, Spanish law shall apply, to which the parties expressly submit, with the Courts and Tribunals of the city of València being competent for the resolution of any conflicts arising from or related to its use.

8. Other Provisions

Kaisushi reserves the right to determine in the future that some of the Website's services shall be governed by independent terms and conditions (which, as applicable, the User may separately accept), and to modify all or part of the Website content.
All rights and obligations of Kaisushi may be assigned to any of its affiliates, or in connection with a merger, acquisition, restructuring, or sale of assets, or by any similar operation. In the event of such assignment, User information will only be transferred in accordance with current laws, and consent will be requested when necessary.
If any provision of this Legal Notice is illegal, invalid, or for any reason unenforceable, such provision may be deemed modified to the minimum extent necessary to make it enforceable, and if not enforceable, shall be severed from this Legal Notice and will not affect the validity and enforceability of the remaining provisions, so that this Legal Notice and the remaining provisions of our Terms shall remain in full force and effect.
